- California law provides special advance-payment rights for residential property insurance claims arising from the January 2025 Los Angeles wildfire emergency. For a covered total loss of a furnished primary dwelling, the insurer must offer a contents/personal-property payment of at least 30% of the policy limit applicable to the covered dwelling structure, up to $250,000, without requiring an itemized contents inventory. A policyholder with a covered total loss who has made an Additional Living Expense (ALE) claim may, upon request, receive an advance of at least four months of living expenses. Additional contents and ALE benefits may be recoverable under the policy after the advance-payment stage and applicable documentation requirements.
